Terms of Service

Welcome to Otha! By signing up for an Otha Account (as defined in Section 1) or by using any Otha Services (as defined below), you are agreeing to be bound by the following terms and conditions (the “Terms of Service”).

As used in these Terms of Service, “we”, “us”, “our” and “Otha” means the applicable Otha Contracting Party, and “you” means the Otha User (if registering for or using an Otha Service as an individual), or the business employing the Otha User (if registering for or using an Otha Service as a business) and any of its affiliates.

Otha provides a complete ecosystem where businesses can create multiple stores, upload their catalogues, and receive others and payments anywhere in the world. Features range from store creation and administration, multiple store ownership, Escrow payment, inventory, marketing, business operations, advertising, relationship management with existing and intending customers. Any new features or tools which are added to the current Services will also be subject to the Terms of Service.

You must read, agree with and accept all of the terms and conditions contained or expressly referenced in these Terms of Service, including Otha’s Privacy Policy.

Accounts

To utilize the Services, you must first create an account, which is only possible for adults that are 18 years of age and above. You must give us your full legal name, business address, phone number, working email address, and any other information requested in order to finish the Account registration process. You agree that Otha‘s primary mode of communication with you will be the email address you specify when registering an account or as updated from time to time.

It is your responsibility to keep your password safe. You agree that Otha cannot and will not be responsible for any loss or harm resulting from your failure to keep your password and account secure. We reserve the right to modify these specifications at any moment and to request additional security measures.

Without Otha‘s prior written consent, you undertake not to replicate, copy, sell, resell, or exploit any part of the service, use of the service, or access to the service.

You consent to refrain from attempting to circumvent, or processing orders outside of Otha‘s Checkout; using any tool to enable features or functionalities that are otherwise disabled in the Services.

Data Protection

Otha is unwaveringly dedicated to safeguarding the privacy of both your and your customers' personal information. You accept and consent to Otha‘s collection, use, and sharing of this personal information by using the Service.

Intellectual Property

You consent to not using any of Otha‘s registered or unregistered trademarks, logos, or service marks. You understand and accept that you are not granted any permission to use the Otha trademark under the Terms of Service.

We need a license to use the materials you give Otha, but we don't claim ownership of them. With respect to any content you provide Otha in connection with the services, you grant Otha a non-exclusive, transferable, sub-licensable, royalty-free, worldwide right and license to host, use, distribute, expose, modify, run, copy, store, publicly perform, communicate to the public (including by telecommunication), broadcast, reproduce, make available, display, and translate such Materials. As well as carrying out our duties and exercising our rights under the Terms of Service, we may make use of the license's rights to run, promote, and offer the Services. You certify that you own all rights necessary to grant this license over the Materials, and you represent and agree to that fact.

KYC

To use our services, we might require you to authenticate yourself. We would need a valid ID, proof of address, and/or your financial information. You give us permission to share these details with databases and security verification organizations. You also give us permission to send these facts, if needed, to government regulatory bodies.

Refund Policy

Otha makes refunds processing within 15 business working days from when the refund request was received.

For yearly memberships, we reimburse the customer for the months in which they haven't utilized the service while refunds for monthly subscription happens when the subscription hasn’t been more than 5 days.

DMCA Notice

Otha encourages its vendors to uphold intellectual property rights and supports such efforts. We reply to all notifications of purported copyright infringement as per our policy. One can submit Otha a Digital Millennium Copyright Act (DMCA) letter if they think that one of our vendors is violating their intellectual property rights.

These requests are processed by Otha within 15 business working days.
